Some lady is really upset about her stay at the hotel and has been posting for about 2 months in the Unfiltered CLP Facebook group. The conversation is a very dramatic display. LOL

I was surprised to see representatives from the park taking part in the squabble by calling names and using profanity.

I didn't see much posted about Pumpkinfest here but read some in the M Tribune.  This weekend at the beach they had their "SEA WITCH" Festival which drew over 150,000 people SPENDING MONEY in Rehoboth Beach and the surrounding area. There was horseback riding on the beach, a BIG PARADE, entertainment, etc. and nice SUNNY weather (70 degrees Saturday)  YES CLP, we know that IF you get the People there, MANY WILL spend some discretionary money at the Park and the surrounding area.  Of course the BIG IF--- is GETING MORE PEOPLE THERE with different themes and attractions. ( ex. Wine/Beer Festivals, Chili/Rib Cookoffs, DOO WOP. Etc.) Oh, speaking of that, The "Doo Wop Kid" (my Karaoke name) did his "thing" there at various places Friday and Saturday nights and no one passed out or threw tomatoes, beer cans etc. at me. (Grin)   { I can't get my emotion faces to post lately and gosh darn it, I used those dang quotation marks again ! ) (smiley)

Good to hear from you DOC!!

Seems that Steve Popovich has filed an objection to the sale of lot 5 in the bankruptcy court today. Now why would he do that? LOL

They have finished installing the foundation and walls for the new house on lot #2. Don't know how far the other work has gotten in the last few weeks.

Factually, per the court filing, the Popovichs, Steve and Joyce, are but one of nine separate parties objecting to the sale of lot 5.

Nine separate parties filed an objection with the bankruptcy court yesterday requesting the court decline the Trustees of Conneaut Lake Park Inc.’s current proposal to sell Lot 5 of lakefront Flynn property.

For newer readers, Lot 5 is the northern most of the lakefront ‘Flynn’ lots being sold off by the trustees, and abuts private properties to the north.

The nine plaintiffs argue to the bankruptcy court that in the trustees’ proposed sale of Lot 5 the Trustees of CLP Inc. is trying to sell property the Trustees of CLP Inc. do not  possess,  no longer owns, and therefore can not offer for sale.

The nine plaintiffs’ motion to the bankruptcy court legally argues that as the plaintiff’s previously filed separate civil case (September 2017) regarding the disputed property is currently being heard in the Court of Common Pleas of Crawford County, that the bankruptcy court should decline the Trustees of CLP Inc.’s current proposal to sell Lot 5 until the County Court rules on legal ownership of the disputed portion of Lot 5.

Just to recap..... for newer readers. The encroachment issue was carved out from the proposed sale of the lot. Remains to be seen if the supremacy clause takes precedence over the county court case. The original encroachment case probably should have been filed with the bankruptcy court in the first place, or transferred upon filing. Popovich may be listed as an interested party in the county case, but it was filed by Mrs. Eakin who is supposedly only seeking access for herself.

The Trustees filed a motion with the bankruptcy court yesterday to sell "Lot 5" along the lakefront. Lot 5 is the parcel carved out of the former Flynn Lots closest to the fence line. The property is being sold despite the current court case over the adverse possession filed by one of the property owners (A. Eakin) relative to access for boat docks on the lakefront.

I apologize for inaccuracy. There are 14 plaintiffs against The Trustees of Conneaut Lake Park in a complaint to "quiet title" with CRAWFORD COUNTY. The same plaintiffs are the ones now challenging the BANKRUPTCY proceedings in reference to the sale of lot 5. The attempt to sell Lot 5 was asked to continue even though the effort to quite title had been filed in the county court. When the complaint was checked at the County Courthouse, Mrs. Eakin was the only plaintiff that was observed attached to the case when it was filed on May 12, 2017, and there were comments made that one of the parties was an attorney who sought lake access for only themselves.

The COUNTY action to Quiet Title has not progressed to a hearing, however the challenge to the BANKRUPTCY sale is scheduled for Nov. 14, 2017. Don't know if the cases will be combined, transferred to Bankruptcy, or put on hold until the entitlement issue is determined.
