At last check, the court actions were closed - or about to be.It appears that Mr. Sutterlin abandoned the proceedings and failed to defend himself against some claims. The parties were working towards a settlement, however. The county court has awarded all rights, interests, and control of Park Restoration to Mr. Popovich. I believe the issue with Horrifying Productions resulted in the dissolving of the LLC.

Mr. Sutterlin is still the object of several other lawsuits at this time.

As for Mr. Popovich, it has not been reported that the EPACC - in January of this year - sought a judgement against Mr. and Mrs. Popovich. The couple then "confessed" to the judgement and agreed to pay the EPACC $74,295.47. A hearing was supposed to have occurred yesterday, May 30, 2018, or on June 4, 2018. Unknown if this was part of the debt incurred when Park Restoration took a loan from the precursor of the EPACC years ago. Those funds were supposed to be used for remodeling the Hotel Conneaut. I believe Mr. Popovich would have assumed that liability when he took over full control of PR. It does appear that Mr. Popovich is attempting to get his affairs in order after the breakup of the partnership.

To be noted, it appears that the Trustees are not the only entity not making payments on their sewer bills.

On a related note: As for the lawsuit against the trustees and the  small piece of land that the group of homeowners sought a "quiet title" action (or adverse possession), that case has not seen any  activity since Jan of 2018. The property owners apparently filed some  faulty paperwork and the court granted them time to correct the issue. Unknown if that paperwork was corrected and submitted or if there are settlement talks being conducted. The property attached to the dispute has since been sold.

Uh, more like tried to avoid it until forced to confront it via legal action.  This was no surprise and was known by Steve for years.

I might have read the entry wrong, but it looked like they were trying to get a consent motion to move the hearing up to 5-30-18 in the judges chambers.

"CONSENT MOTION TO CONTINUE HEARING (TO CHAMBERS 5/30/2018)"

It could have meant they filed the motion to continue the hearing to some other date and that it was delivered to the judges chambers on 5-30-18. Without being at the courthouse I can't read the actual motion.........

I just viewed the last video that Sir Gore posted about opening weekend and I must say that the Park looks better than I have ever seen it in MANY years.  The pale yellow (looks like that color to me from the video) and only white posts of the Midway Game Area seems a little to ordinary to me, but only my immediate impression.  Whenever they have the money to repave a lot of the asphalt, will be a BIG Improvement also, of course.  Sure do miss the Beach Club as many do.  All in All, a FINE JOB for all those involved.  Now, all they need is the Crowds, of course.  Let's hope that old phrase of "If they build it, They will Come" holds true for our Loved Park.
