In case the masses were wondering..... the Bankruptcy Court has dismissed the companion case against the Trustee's by Park Restoration for recovery of the insurance funds (again). I would anticipate at least one more effort by PR to try and position itself to recover the funds. PR now has 14 days to file an appeal (from Friday) if it wishes.

....for the many new readers unfamiliar with the relevance of the three  comments posted above, , a brief synopsis of the background relationship-

....the GoErie article of the reopening of the Erie haunted attraction posted/linked above cites comments made the Eeriebyss Factory of Terror owner, Greg Sutterlin.

The posting/link immediately above cites the bankruptcy court dismissing with prejudice Park Restoration Limited Liability Corporation’s (PRLLC) actions against the park trustees regarding PRLLC legal effort to recover PRLLCs’ Beach Club insurance payment, a majority of which was paid to the taxing authorities per established PA statutes on destroyed properties which were delinquent  on property taxes..

Greg Sutterlin was the primary entity in operating Park Restoration Limited Liability Corporation (PRLLC) when PRLLC leased and operated the Beach Club. PRLLC  had just completed remodeling the adjacent former lake front park cafeteria into the Dockside Banquet Facility when both facilities were destroyed in the August 1, 2013 fire of undetermined cause.

Sutterlin was the primary PRLLC entity leasing and operating the Hotel Conneaut when the park board of trustees unilaterally terminated the PRLLC hotel lease, according to GoErie, “failed to pay rent and meet other lease obligations in 2015 and evicted PRLLC from park property.



Local media reports are replete with reports over the years of Sutterlin unilaterally initiating numerous PRLLC projects/actions in CLP without coordinating with the park board of trustees or obtaining the required building permits from local authorities.



After the Beach Club burnt down in August of 2013, PRLLC publicly stated they would rebuild the Beach club. PRLLC prompted and held a rock concert benefit at PRLLC’s lake front fenced in “concert facility featuring local bands donating their time and efforts, to raise money for the Beach Club replacement.



PRLLC stated on their concert Facebook page and are reported by the local press  stating that if the Beach Club was not built that PRLLC would donate the raised funds to the volunteer fire departments that responded to the August 2013 Beach Club fire.

To date, I am not aware of any reports in the local press of any of the respective volunteer fire departments receiving any Beach Club Rebuild concert funds from PRLLC.

On a side note, and unreported by the local press, the park board of trustees bankruptcy plan, the board officially stated to the park creditors and bankruptcy court the park would begin the process for rebuilding the Beach club in 2018, with construction finishing in 2019.
   
Sutterlin is reported in the press as having attempted to unilaterally file bankruptcy for PRLLC, but the court declined the application as Sutterlin’s partner reported to the court that Sutterlin did so without the PRLLC corporative partner’s  knowledge or approval of the bankruptcy application.

In the January 10, 2015 TRIBLIVE article referenced above, writer Vidonic reports, “ In October, the Conneaut Lake Municipal Authority filed a $23,238 lien against the land housing the hotel, saying either trustees or Park Restoration owes money for sewer service between July 1, 2011 and June 30, 2014.
   Park Restoration has had an agreement since 2009 to pay $432,000 owed to the municipal authority as an alternative to paying rent, Turner said, but the company hasn't been making payments.
   “I'm not paying that, frankly, because of this possible tax sale,” Sutterlin said, referring to a possible sale of the park property for unpaid taxes.
   Sutterlin said he's been concentrating more on making lease payments in recent months, but that the company has paid about $121,000 toward the authority debt.
   Sutterlin and his estranged business partner, Steve Popovich, half-owner of Park Restoration, are also mired in a court battle, with Popovich demanding a full financial accounting of the business.


According to park bankruptcy filings, the $23,238 lien against the hotel property remains unpaid.

Toes, as a result of the lawsuit that was filed by Mr. Popovich against Mr. Sutterlin several years ago when Popovich was locked out of the hotel, Mr. Popovich was given complete control over the Park Restoration LLC when Mr. Sutterlin failed to offer a rebuttal and defense of the complaint in the county court.

Popovich, unless he has added a new business partner, has complete control over PR. He was also given control of the "Horrifying Productions  LLC" which they were also joint partners. If I remember correctly, the Horrifying Productions LLC was set to be dissolved, but not sure if that happened since they appeared to be negotiating a settlement. I have not heard who is running the haunt at the Tavern 618 or if Sutterlin has formed a new LLC to run the Erie haunt. 

UPDATE: After some quick strokes of the computer keys this is the scoop on the Erie property where the haunt is located. It was bought through a "tax deed" for $26,009 which I assume was the back taxes owed on the property (Sutterlin was in arrears for $21,069.19 in 2016). The property transferred out of Horrifying Productions LLC and into the hands of .................... Lisa Sutterlin on 16-Feb-2017.

TORNADO WARNING for the CLP area. A large tornado has been indicated on radar moving from Ohio into Crawford County. A quick glance at the radar does show very strong rotation with this storm.
